Acceptance
By using the heapoverflow.dev marketing site or the InfraTwin product, you agree to these terms. If you have a master services agreement with HeapOverflow, that agreement governs in case of conflict.
Service
InfraTwin is a cloud infrastructure digital twin platform. It mirrors your environment in read-only mode and runs simulations against the model. It does not mutate your cloud. Availability commitments are defined in your order form's SLA.
Acceptable use
Don't probe, scan, or attempt to disrupt InfraTwin. Don't use the service to violate laws, infringe rights, or simulate environments you don't own or have authorization to model. Don't share access credentials.
Data ownership
You own your customer data. We process it only to deliver the service and as instructed in your DPA. We do not train models on customer environment data.
Fees & billing
Subscription fees are billed under your order form. Late payments accrue interest at the lower of 1.5% per month or the maximum rate permitted by law. Annual commitments are non-cancelable for convenience.
Warranty disclaimer
The service is provided 'as is' with the warranties expressly stated in your order form. Simulations are decision-support tools, not guarantees about production. Always exercise human review for high-stakes changes.
Liability
Aggregate liability is capped at amounts paid in the 12 months preceding the claim. Neither party is liable for indirect, consequential, or punitive damages. This does not limit liability that cannot lawfully be limited.
Termination
Either party may terminate for material uncured breach after 30 days notice. On termination, we will provide a reasonable export window and then delete customer data per your DPA's retention schedule.
Changes
We may update these terms with at least 30 days notice for material changes. For breaking changes affecting customers under contract, the contract governs the upgrade path.
Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict of laws provisions. Disputes are resolved exclusively in the state and federal courts located in New Castle County, Delaware.
